BEFORE DEATH

Create your will

A Legal Will in Queensland is a legally binding document that sets out how you want your assets and belongings distributed after your death. It allows you to appoint an executor to manage your estate, and, if relevant, nominate guardians for your children. To be valid, a Will must meet specific legal requirements, including being properly signed and witnessed. Having a valid Will ensures your wishes are clearly documented and helps reduce stress and uncertainty for your loved ones.

Enduring Power of Attorney

An Enduring Power of Attorney (EPA) in Queensland is a legal document that allows you to appoint one or more trusted people to make decisions on your behalf if you lose the capacity to do so. You can authorise them to manage personal matters (including health care) and/or financial matters, depending on your preferences. The document continues to operate if you lose decision-making capacity and must be made voluntarily while you have capacity.

Statement of Choices

A Statement of Choices is a document that records your values and preferences for health care. While it isn’t legally binding and doesn’t provide consent to or refusal of treatment, it helps guide family, substitute decision-makers and health professionals if you’re unable to make decisions yourself. There are different forms for adults and for children and young people, including options for those with decision making capacity and for legally appointed decision makers completing the form on someone’s behalf. Forms are also available for Aboriginal and Torres Strait Islander peoples. The document is signed by the person completing it, along with a doctor or nurse practitioner and anyone who assisted with the planning process.

Advance Health Directive

An Advance Health Directive is a legal document that lets you record your wishes for future health care if you’re ever unable to make decisions for yourself. It covers medical treatment, mental health care, life-sustaining measures, and special procedures, and allows you to appoint a trusted person to make decisions on your behalf. The document must be completed voluntarily by an adult with capacity, signed by a doctor, and witnessed by an eligible professional, but it does not need to be registered.
