These Terms of Service apply to services provided by Rest Funerals & Death Care Pty Ltd ABN 75 658 378 799, trading as Rest Funerals & Death Care, Rest Funeral Services and MyRest Funerals (“Rest”, “we”, “us” or “our”).
We understand that arranging a funeral can be difficult, particularly at a time when there is a lot to think about and organise. We have written these terms in plain English so that you can understand what you are agreeing to and what you can expect from us.
These Terms apply to our funeral and death care services and, where relevant, to your use of our websites.
Your individual proposal, quote or other written agreement with Rest will set out the services you have selected and the prices that apply to your particular arrangement. If there is any inconsistency between these Terms and a specific written agreement, the specific written agreement will generally apply.
1. Our services
Rest provides funeral and death care services ranging from simple unattended cremation through to traditional funeral services, burials and other arrangements.
We aim to provide clear, itemised proposals so that you can see what is included, what is optional and what is being charged by third parties.
The services we provide will depend on the arrangements you have selected and the details set out in your proposal or agreement.
Unless specifically included in your proposal, the following are generally not included:
- funeral or memorial service arrangements;
- printed booklets or service stationery;
- slideshows or audiovisual production;
- music or musicians;
- flowers;
- dressing of the deceased;
- makeup or hair preparation;
- transport outside the agreed service area;
- additional pallbearers; and
- other products or services not specifically listed in your proposal.
If you require something that is not included in your proposal, please ask us. Where possible, we will provide you with the additional cost before arranging it.
2. Services Rest does not provide
Rest does not provide:
- embalming; or
- reconstruction of the deceased.
Where a family requires a service that Rest does not provide, we may be able to help you identify an appropriate third-party provider.
3. Your proposal and agreed services
Your proposal will set out the services, products and fees that apply to your arrangement.
We encourage you to review the proposal carefully and ask us about anything that is unclear before accepting it.
Once you have accepted a proposal, we will arrange the agreed services.
If you later request additional services, products or changes to the arrangements, we will discuss any additional costs with you before proceeding wherever reasonably possible.
We will not add optional services or charges simply because they are available.
4. Third-party fees and charges
Some costs associated with a funeral are charged by third parties rather than Rest.
These may include fees charged by:
- crematoriums;
- cemeteries and burial authorities;
- medical practitioners;
- government authorities;
- churches or other venues;
- celebrants;
- transport providers; and
- other suppliers or service providers.
Where a third-party fee is known at the time of preparing your proposal, we will include it in the proposal.
Where a third-party fee is subject to change, unavailable at the time of quoting, or dependent on circumstances outside our control, we will explain this to you where reasonably possible.
Third-party fees are passed on at the amount applicable to your arrangement unless otherwise stated in your proposal.
5. Pricing
Our prices are intended to be clear and itemised.
The price shown in your accepted proposal is the price that applies to the services and products described in that proposal, subject to:
- changes requested by you;
- additional services requested after acceptance;
- third-party charges that were not known or able to be confirmed when the proposal was prepared; and
- circumstances outside our reasonable control that result in an unavoidable additional cost.
We will discuss additional costs with you before incurring them wherever reasonably possible.
Prices displayed on our websites, brochures or other general pricing information are indicative unless specifically stated to be a fixed price or are incorporated into an accepted proposal.
6. Transport
Our standard transport pricing applies to the service area specified in our current pricing information or your proposal.
Where collection or transport is required outside the agreed service area, an additional charge may apply.
We will advise you of any additional transport charge before proceeding wherever reasonably possible.
7. Pallbearers
Families are generally responsible for providing sufficient people to act as pallbearers where a coffin or casket needs to be carried.
As a general guide, a Daisybox or similar lightweight casket will normally require at least four capable people, while a standard coffin or casket may require six.
Rest may be able to provide limited assistance with pallbearing. Additional assistance may be available through third parties, subject to availability and any applicable charge.
Please tell us as early as possible if you anticipate that additional pallbearers will be required.
8. Payment
Payment terms will be stated on your invoice or proposal.
Unless otherwise agreed, invoices are payable within the period stated on the invoice.
If you need additional time to pay or would like to discuss a payment arrangement, please contact us. We would rather discuss this with you than have payment concerns add unnecessary stress during an already difficult time.
Payment by credit card
Where payment is made by credit card, a card processing fee may apply.
The applicable fee will be disclosed before payment and will not exceed the amount permitted by law.
Where payment is made by bank transfer or another payment method for which no surcharge applies, no card processing fee will be charged.
9. Pre-arranged and pre-paid funerals
Rest offers options for people who wish to make arrangements in advance.
The way advance payments are held depends on the type of arrangement and payment option selected.
Where a funeral bond or other regulated financial product is used, the relevant product provider’s terms and applicable legislation will also apply.
If you are considering arranging or paying for a funeral in advance, we will explain the available options and how the money is held before you decide.
10. Information provided by you
We rely on information provided by you, your authorised representative or other appropriate persons when arranging a funeral.
This may include information required for:
- registration of a death;
- government forms and records;
- medical and cremation documentation;
- burial or cremation arrangements;
- funeral notices and stationery; and
- other documents associated with the funeral.
Please take care to provide accurate and complete information.
Where information needs to be corrected, please tell us as soon as possible.
11. Death registration and certificates
Information provided to Births, Deaths and Marriages Queensland for registration of a death is based on information supplied to us by the client, next of kin or another authorised person.
Rest will take reasonable care when preparing information and forms, but we cannot independently verify every detail supplied to us.
The issue of official certificates and other government documents is controlled by the relevant government authority.
Where you require a certificate or other document from a government authority, processing times are determined by that authority and are outside Rest’s control.
12. Medical certificates and Cause of Death information
Where a medical certificate or Cause of Death document is required, the relevant document must be completed by the appropriate medical practitioner or authority.
Rest cannot issue or amend medical certificates and cannot guarantee the time taken by a medical practitioner or government authority to issue a document.
If you require a certificate for an insurance company, bank or other organisation, please allow sufficient time for the relevant authority to issue it.
13. Changes to arrangements
Funeral arrangements can sometimes change.
If you request a change to the services, products, timing, location or other arrangements after accepting a proposal, we will discuss the change with you and advise you of any additional cost or refund that may result.
We will not unreasonably refuse a requested change where it is reasonably possible for us to accommodate it.
Some changes may not be possible because of legal requirements, availability, timing or the requirements of third-party providers.
14. Cancellation
If you wish to cancel or substantially change an arrangement, please contact us as soon as possible.
The amount payable following a cancellation will depend on the circumstances, including:
- services already provided;
- products already supplied or ordered;
- third-party fees already incurred;
- costs that cannot reasonably be recovered; and
- any rights you have under the Australian Consumer Law or other applicable legislation.
We will discuss the consequences of cancellation with you before applying any cancellation-related charge where reasonably possible.
Nothing in these Terms limits any cancellation, refund or other rights you may have under the Australian Consumer Law.
15. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
You may have additional rights where our services do not meet the consumer guarantees that apply to your circumstances.
Nothing in these Terms is intended to exclude, restrict or modify any right or remedy that cannot legally be excluded, restricted or modified.
16. Our responsibilities
We will provide the services described in your accepted proposal with due care and skill and in accordance with applicable laws and regulatory requirements.
We will communicate with you about matters that materially affect your arrangements and, where reasonably possible, discuss changes or additional costs with you before they are incurred.
We will also treat the person who has died and the people arranging the funeral with dignity, care and respect.
17. Circumstances outside our control
Some aspects of a funeral depend on third parties, government authorities, medical practitioners, crematoriums, cemeteries, venues, transport providers, weather or other circumstances outside our reasonable control.
Where such circumstances affect your arrangements, we will take reasonable steps to communicate with you and find an appropriate alternative where possible.
Nothing in this section limits your rights under the Australian Consumer Law.
18. Website information
Our websites provide general information about Rest, our services and funeral-related matters.
We take reasonable care to ensure that information published on our websites is accurate when published. However, information may change over time, including pricing, availability, services and third-party fees.
Website information should not be treated as a substitute for the specific proposal or advice we provide for your individual circumstances.
Where there is a difference between general website information and an accepted proposal, the accepted proposal will apply.
19. Links to other websites
Our websites may contain links to websites operated by third parties.
These links are provided for convenience or information. Rest does not control those websites and is not responsible for their content, availability, privacy practices or terms of use.
The inclusion of a link does not necessarily mean that Rest endorses the organisation, service or information provided by that website.
20. Intellectual property
Unless otherwise stated, the content on our websites, including text, photographs, graphics, logos, branding, documents and other material, is owned by or licensed to Rest.
You may access and use our websites and their content for your own personal, non-commercial purposes.
You must not reproduce, modify, distribute, publish, sell or commercially exploit our content without our written permission, except where permitted by law.
This does not affect any rights you may have under applicable copyright legislation.
21. Website security and availability
We take reasonable steps to maintain the security and availability of our websites and online systems.
However, we cannot guarantee that our websites will always be available, uninterrupted or free from errors, viruses or other harmful components.
You are responsible for taking reasonable precautions when accessing websites and downloading or opening material from the internet.
22. Privacy
Our collection, use, storage and disclosure of personal information is explained in our Privacy Policy.
Our Privacy Policy forms part of the information governing your relationship with Rest and should be read together with these Terms.
23. Complaints and concerns
If you have a concern about our services, your arrangements, an invoice or these Terms, please contact us as soon as possible.
We will try to resolve concerns directly and fairly.

Nothing in these Terms prevents you from exercising any rights available to you under Australian law.
24. Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements.
The current version will be published on our website.
For a funeral or other service that has already been agreed with you, changes to these website Terms will not retrospectively alter the specific terms of your accepted proposal or agreement.
25. Governing law
These Terms are governed by the laws of Queensland, Australia.
Any dispute will be subject to the applicable laws and courts of Queensland, except where Australian law provides otherwise.
